Kevin James Enders on Oath States:-
I am a constable of Police Stationed at Charters Towers. Neither
of the deceased persons Susan Mary McVean or Alexander Cameron McVean
were known to me. I remember Thursday the 23rd November, 1961
last. At about 10.10pm on that date I received certain
information. I was told that an accident had occurred on the
Townsville road near Chinaman's Creek. A man I now know as Arthur
Downey gave me that information. I immediately drove to the scene
of the accident which was on the main Townsville Charters Towers
road about 200 yards on the
Townsville side of Chinaman's Creek, about
5 miles from Charters Towers. On arrival at the scene I saw that
two motor vehicles had collided. A ford Zephyr sedan number Q
656-305 and an International Panel Van number NLA-724. The Ford
Sedan was facing towards Townsville in the middle of the road straight
along the road. It was just about 2 feet over the centre of the
road. It was extensively damaged around the front near
side. I ascertained that this vehicle had been driven by Alison
McVean and had been traveling towards Townsville. The offside
headlight of this vehicle was burning but I did not notice if it was on
high or low beam at that time. The driver and the passengers of this
vehicle apart from the deceased woman Susan Mary McVean had been
conveyed to the Charters Towers Hospital by ambulance prior to my
arrival.
The International Panel Van was hard up against the near side of the
front of the Ford sedan, that is the near side front of the panel van
was hard up against the front of the Ford. The vehicles were
locked together. The international was facing towards Charters Towers
and was at an angle to the Ford. The front offside of the
International was on the bitumen about one foot from its incorrect side
of the road, and the offside rear wheel was off the bitumen about two
feet from the edge of the bitumen. The vehicle was extensively
damaged on the front near side. This vehicle was driven by Alfred
Charles Organ and had been travelling towards Charters Towers. The Ford sedan had just travelled over
the crest of a hill and was on a slight downgrade at the point
of impact. The International Panel Van would have been travelling
up a slight grade.
The point of impact was approximately 50 yards from the crest of a hill.
The
road
as the scene of the accident was a straight road and about 100
yards on the Townsville side and at the bottom of the grade that the
vehicles were on, the road turns to the left coming towards Charters
Towers. The turn to the left is a slight turn. Where the
accident occurred was a straight road. That would mean that the
International had negotiated a slight turn to the left about 100 yards
before the impact. The
deceased person was lying on a mattress on the near side of the Ford
sedan. The driver of the international panel van was still seated
on the driving seat of his vehicle. [EDIT: He had been seated there
since the collision. Of course he saw what happened to the
'deceased person'. He lied later to the detective when interview in
hospital when he stated that he did not know that a person had died. ]
I went over to him and had a conversation with him. I asked him
to get out of his vehicle and he said that he could not as the door was
jammed. I used some force and opened the door and I again asked
him to alight. He told me he couldn't as his knees had been
injured in the accident. An ambulance arrived at that time and I
told him to remain seated until the bearers had examined his
injuries.
