Oath states:
My name is Hugh Douglas McVean.
I am single I am
seventeen years of age. I reside with my brother at 5 Bristol St,
Gulliver, Townsville. The deceased persons Susan Mary McVean and
Alexander Cameron McVean were my mother and father. I was a
schoolboy at All Souls School Charters Towers on Thursday 23rd
November, 1961. I was a student at this school. The school
had a Speech Night on the night of this day. My parents and my
sister Alison McVean travelled by car from Townsville to charters
Towers for the purpose of attending the Speech Night. They
travelled in a Zephyr Ford Sedan. My uncle Hugh Victor Byers
owned the vehicle. He resided in Townsville at
20 Harold Street, West End. After the speeches I intended to
return home with my parents. The speeches finished at about
10 o'clock. I
then went to the
dormitory and
collected my
luggage. There was my parents, my sister and myself in the
vehicle. After the speeches we went to the Service Station on the
Road on the Charters Towers side of the school. At the service
station my mother had a "Bex" powder with a drink and the others had a
drink. We did not buy
sandwiches as they had sandwiches with
them. When leaving the service station, my sister
was driving the
car. My mother was sitting in the seat next to the driver.
My father was behind the driver in the back seat. I was in the
back seat behind my mother. Shortly after leaving
the Service
Station, I was eating sandwiches. My mother was eating sandwiches at
the same time. As far as I know my sister was not eating
sandwiches. I remember cars coming from All Souls as we passed
and they were heading towards Townsville in the same direction as we
were travelling. I saw only one headlight approaching. I noticed
this headlight when it was right in front of us. I was eating
sandwiches at the time. Before crossing the bridge I noticed the
speed of the vehicle was at 45 miles per hour. I did not see the
vehicle lights until right upon them because I had my head down eating
sandwiches. The lights of
the oncoming vehicle were very
bright. I would not know if they were on high or low
beam.
I would not know if the vehicle in
which I was a passenger had its
lights on high beam. When my sister saw the lights she
swung the vehicle towards the centre of the road to avoid a
collision. The oncoming vehicle was in our direct path and
on the
incorrect side of the roadway. I can remember just before I was
placed in the ambulance. I was taken to the Charters Towers
Hospital. I was admitted to the hospital. There had been no
rain on the night of the occurrence and the road was dry. There
was not many vehicles going in front of me.

finished a sandwich at the time of the
collision.

watching
at the time of the collision. A. I was eating a
sandwich and I just put my head up
at the time of the collision.
Q. Had it
been a
rather strenuous day and evening at
the school. A. No.
Q. Were you
feeling
sleepy as you were going along.
A. As sleepy as I ever am
at 10 o'clock.
Q. What was your
usual
bedtime at school. A. At half-past nine or a
quarter to ten.
