Healthy female "dog" to breed with Parson Russell Terrier, to produce ASSISTANCE DOGS.   Rochedale South QLD 4123
I wish to breed from my Parson Russell Terrier. He is a trained assistance dog. He has a wonderful nature. The breed of his mate could be varied or a cross; eg Parson Russell Terrier, Jack Russell Terrier, Beagle, Bull Terrier, Bull mastiff, Staffy, and/or Fox Terrier plus many others. She does not need to be "pedigreed". I am very protective of my dogs. She will become very valuable to me and become one of my assistance "dogs". If we can assist each other, please contact me on my contact form, including your email address and your landline phone number so I can phone you to discuss. 

Because I am disabled and have an LLB [so therefore understand the Law surrounding disabilities and assistance dogs] I am now branching out to providing Assistance dogs to disabled persons [even if disabled in only a minor way and so not even realizing it]. This is not a business proposition but rather just a very necessary service I can offer to the community.
Many people have a disability and do not realize their ailment or "problem" is by law, the Disability Discrimination Act 1992 (Cth) [DDA], classified as a "disability". This is especially so for people getting on in years, and who have a dog, and are maybe moving to accommodation where they are told they cannot take their dog. In a majority of cases, those people cannot be legally forced to surrender their animal/dog.
I will be assisting those person who already have dogs, but are being forced, unlawfully, to dispose of them because maybe they are moving accommodation. I can train your existing dogs to be assistance dogs and provide the documentation as required by the Disability Discrimination Act 1992 (Cth) [DDA]. I do not intend to charge for this, but just maybe cover some marginal costs.

This is my preliminary submission for the QCAT hearing at Court 1, Holland Park, 9:30am Monday, 15th April, 2013 #0042/13..

This matter can be quickly finalized today.  The agents for the Brisbane City Council [BCC] have sued the wrong party.   I am not the tenant in the subject tenancy agreement.  I cannot be evicted as I am not the tenant or lessee. 

I cite the precedent of Salomon v A Salomon & Co Pty Ltd [1897] AC 22.

From the 15th February, 2009, when the Company Face 2 Face Foundation Pty Ltd entered into a lease contract with Mario Di Carlo for the 5 acre property at 953 Rochedale Road, Rochedale South, Face 2 Face Foundation Pty Ltd has had sole exclusive possession of the property at 953 Rochedale Road, Rochedale South.  Until approximately three years ago, I was a director of Face 2 Face Foundation Pty Ltd and negotiated the lease with Mario Di Carlo.    I have not been a director of Face 2 Face Foundation Pty Ltd since.

Regardless of whether Face 2 Face Foundation Pty Ltd has excluded me from the property at 953 Rochedale Road, Rochedale South, I cannot unilaterally by myself nor can the lessor unilaterally give me exclusive possession of the property at 953 Rochedale Road, Rochedale South.

As is usual in business, when Mario addressed a letter to Face 2 Face Foundation Pty Ltd he addressed it to me as a director of Face 2 Face Foundation Pty Ltd as shown in his letter of Adornment's with the file name

 as attached.  I advise I am prepared to swear to the origins of all attachments as documents of which they purport to be copies in that those imprinted with IP release are direct prints of documents forwarded to me by Brisbane City Council as a result of an IP Application [Information Privacy Application].

It would appear that the Brisbane City Council has made an error in including my name on the RTA contracts.  As Face 2 Face Foundation Pty Ltd had sole exclusive possession, then  and at all times since, neither the Brisbane City Council, nor any property owner can lease a property concurrently to a second lessee/tenant when another party already has sole exclusive possession of the property.  Such would be ultra vires.  All "agreements" purporting to be between me and Brisbane City Council are void ab initio as to any substance as against me. At no times since the 15th February, 2009 has Face 2 Face Foundation Pty Ltd been evicted or vacated the property at 953 Rochedale Road, Rochedale South.  For that duration Face 2 Face Foundation Pty Ltd has retained sole exclusive possession.


Hence, my name should be severed from all tenancy contracts where my name "Chris Newton" is included under the Item entitled "Tenant".   Face 2 Face Foundation Pty Ltd remains listed as a "Tenant".

The Brisbane City Council were aware that Face 2 Face Foundation Pty Ltd had sole exclusive possession of the property at 953 Rochedale Road, Rochedale South. prior to its settlement of the sale of the property on 21st December, 2009.  This is shown in the Brisbane City Council letter in the file called

This is a letter wherein the Brisbane City Council advises its instructions to Mario Di Carlo re "your proposed General Tenancy Agreement to Face 2 Face Foundation Pty Ltd"

At all times during the relevant period,  it has been only Face 2 Face Foundation Pty Ltd who has paid rent on this property at 953 Rochedale Road, Rochedale South.  I, Chris Newton, have never personally paid any rent for this property for which Face 2 Face Foundation Pty Ltd has had sole exclusive possession.

I have never been in partnership with Face 2 Face Foundation Pty Ltd.    The fact that documents including my name and Face 2 Face Foundation Pty Ltd as "tenants" has had the "endorsement" of Face 2 Face Foundation Pty Ltd has not has the effect of making me a partner with Face 2 Face Foundation Pty Ltd.  

QCAT is duty bound to deliver Natural Justice. An important aspect of NJ is the "Right to be Heard". "Right to be Heard" means that before a person/entity can be harmed or disadvantaged, they must be given the right to be heard by an unbiased tribunal. Because Face 2 Face Foundation Pty Ltd has not been served and is not being sued, it has not been given the right to be heard. Therefore an order cannot be made against Face 2 Face Foundation Pty Ltd

This application should be dismissed forthwith.
